IP Lawyer in Liechtenstein: Enforcement and Domain Disputes
LFT prepares and coordinates; the licensed Liechtenstein lawyer acts. We build the evidence file for court, customs or WIPO.
- Customs hold: up to 10 working days, plus up to 10 in justified cases
- Customs decision: within 40 days
- Approved application: valid 2 years

How we handle an IP dispute
We prepare and coordinate the evidence file. The licensed Liechtenstein lawyer, named in your engagement letter, acts for you (RAG Art. 8(1)(b)), and a licensed patent attorney may also act in IP matters (PAG Art. 8(1)). If your mark is not registered yet, start with our trademark registration service: the performance action needs a registered mark.
There are three routes. Civil and criminal cases go to the Landgericht. Customs assistance stops suspect goods at the border. A .li domain goes through the WIPO procedure. No outcome is promised on any of them.

Strategy and representation
Any warning letter, the court filing and the appearance are done by the licensed lawyer; a patent attorney may act in IP matters.

Declaratory action, prohibition, removal and disclosure, damages and account of profits, and interim injunctions, all before the Landgericht.
Criminal complaint
Filed through the partner. Up to one year or 360 daily rates on the injured party's request; commercial infringement goes to the public prosecutor.
Customs assistance
We prepare the application documents; the partner files them with the Office of Economic Affairs. Destruction of the goods can be requested.
.li domain dispute
We prepare the WIPO request; a signed power of attorney is filed with it, and the partner acts.
Who it is for
Rights holders based abroad
With no domicile, seat or establishment in Liechtenstein, another EEA state or Switzerland, you need a lawyer or patent attorney established in Liechtenstein or admitted there for temporary practice in trademark proceedings (MSchG Art. 39(1)). A party established in the EEA or Switzerland needs only a domestic address for service (Art. 39(2)).
Copyright owners and goods at the border
Copyright claims run under URG Art. 57(1); the customs application goes to the competent body under URG Art. 71.
Owners of a .li name
WIPO runs the procedure. The claimant must hold a right in a distinctive sign under Liechtenstein law.
Rights held through a structure
A family structure is covered in our foundation structuring overview; a Liechtenstein entity's seat sits with the seat and the contact person every Liechtenstein entity needs. This page covers enforcement only.
How an IP dispute runs
This page states no time for steps 1 to 4 and 7; the customs periods are set by law (MSchG Art. 70(3), (4); MSchV Art. 45).

Problems we solve

A mark that is not registered yet
The performance action can be brought only after registration (MSchG Art. 53(2a)). Registration comes first, through the trademark page linked above.
The customs clock is short
At most 10 working days, plus up to 10 in justified cases. A destruction request in the ordinary procedure does not lengthen them (Art. 69(4)). We prepare the injunction file in advance, ready if customs notifies a hold.
Registering a domain is not disputing one
A registrar registers a .li name and NIC Liechtenstein administers .li. A dispute goes to WIPO, and standing needs a right in a distinctive sign owned under Liechtenstein law.
The Zurich courts clause
By requesting an expert decision, the claimant submits to the courts of Zurich for any court proceedings the respondent starts against that decision.
Patents and the Swiss territory
Liechtenstein and Switzerland form one protection territory for invention patents (Patentschutzvertrag Art. 1). Patent matters sit on the patent page below.

Why work with us
Dominik Heeb, our corporate files lead, prepares IP files that a patent attorney or lawyer then files. LFT is not a law practice: we do not appear in court, give no legal advice and promise no outcome. The licensed Liechtenstein lawyer, named in your engagement letter, acts; unauthorised commercial exercise of an activity reserved to lawyers or legal agents is an offence (RAG Art. 103).
IP enforcement in Liechtenstein: questions
Is LFT a law practice, and does it have its own counsel?
No. LFT prepares and coordinates the evidence file. Professional party representation is reserved to lawyers under RAG Art. 8(1)(b), without prejudice to the statutory powers of legal agents, trustees and patent attorneys (Art. 8(3)); unauthorised commercial exercise of a reserved activity is an offence (Art. 103). The licensed lawyer is named in your engagement letter.
Can LFT represent me in court?
No. The licensed Liechtenstein lawyer named in your engagement letter files and appears. LFT collects the documents, orders the evidence and coordinates between you and the lawyer. This follows RAG Art. 8(1)(b). The lawyer decides the strategy, and no outcome is promised.
Do I need a lawyer in Liechtenstein if I am based abroad?
In trademark proceedings, a party with no domicile, seat or establishment in Liechtenstein, another EEA state or Switzerland must appoint a lawyer or patent attorney established in Liechtenstein or admitted there for temporary practice (Art. 39(1)). A party established in the EEA or Switzerland needs only a domestic address for service (Art. 39(2)).
Does my trademark have to be registered before I can sue?
For the performance action (prohibition, removal and disclosure), yes: it can be brought only after the mark is entered in the register (Art. 53(2a)). A declaratory action needs a proven legal interest (Art. 50). A mark that is not registered yet goes to the trademark registration route first.
Can I get an interim injunction quickly, and what must I show?
The applicant must make it credible that the right is infringed, or that an infringement is feared, and that a disadvantage not easily repaired threatens (Art. 57(1)). The Landgericht decides. This page states no court duration and no court fee, because none was read.
What else can the court order besides a ban?
Besides prohibition, the Landgericht can be asked for removal and disclosure (Art. 53(1)). In interim proceedings it can order evidence preservation, tracing of the origin of marked goods, preservation of the status quo and provisional enforcement of prohibition and removal claims (Art. 57(2)).
Can I claim damages and the infringer's profits?
Civil claims for damages, satisfaction and an account of profits remain open beside the performance action (Art. 53(2)). This page states no amount and no likelihood of success. Whether to claim them is decided with the licensed lawyer, once the evidence file is complete.
Can I file a criminal complaint instead of, or as well as, a civil case?
The Act provides both routes. Intentional infringement is punishable on the injured party's request by up to one year or 360 daily rates (Art. 59(1)); commercial infringement by up to three years, prosecuted by the public prosecutor (Art. 59(3)). The licensed lawyer decides which route to use and in which order.
How do customs measures work against counterfeit goods?
The customs authority may notify the right holder of suspect goods and hold them for three working days (Art. 68(2)), so the right holder can file an application. For a trademark it goes to the Office of Economic Affairs, which forwards it. The applicant may also ask for destruction of the goods.
How long does customs hold suspect goods, and what must I do in that time?
Three working days on notice. On an approved application the goods are held for at most ten working days after the applicant is notified (Art. 70(3)), and for up to ten more in justified cases (Art. 70(4)). The hold lets the right holder seek an interim injunction, so the file is best prepared in advance.
How does a .li domain dispute work, and who decides it?
WIPO runs the procedure, a variation of the UDRP. It starts with a conciliator and a telephone conference of up to one hour. If conciliation fails, or the respondent does not take part, and the claimant has asked for it, WIPO appoints an expert. A represented claimant files a power of attorney.
Does my foreign trademark qualify for a .li dispute?
The claimant must prove a clear infringement of a right in a distinctive sign that it owns under the laws of Liechtenstein. Whether a foreign mark alone meets this is not stated, so the partner confirms it on the facts. Requesting an expert decision submits the claimant to the courts of Zurich for proceedings against that decision.
What about patents, given the Swiss shared territory?
Liechtenstein and Switzerland form one protection territory for invention patents (Patentschutzvertrag Art. 1). A licensed patent attorney advises and represents in intellectual property matters (PAG Art. 8(1)). Patent filings are handled on their own page, so this page does not restate them.
Which documents should I prepare?
The registration certificate of the mark, or the work and proof of its authorship for copyright; screenshots, test purchases and correspondence that show the infringement; a goods description for a customs application; for a .li name, proof of a right in a distinctive sign under Liechtenstein law; and a signed power of attorney.
What does it cost?
Our fee and the partner's are quoted on request after the case intake. The customs authority may charge an administrative fee and held goods are stored against a fee (MSchG Art. 69(7), MSchV Art. 46(1)); WIPO publishes a schedule of fees. No court, customs or WIPO amount was read, so none is quoted here.
